Australian visa support for Ukraine nationals


Australia’s Department of Home Affairs has announced its significant support to nationals of Ukraine that includes the following:

  • all of their visas will be automatically renewed for a further six months, if their visas are expiring prior to 30th June 2022 and they are already onshore Australia;
  • processing visa applications from all visa categories as a top priority;

If they are already in Australia and their visas are expiring prior to the 30th June 2022, their visas will be automatically renewed. They do not have to re-apply for any other visas. Instead, the Department of Home Affairs will be contacting each visa holder in Australia to check if they wish to extend their stay in Australia.

Work limitation of 40 hrs/fortnight suspended til further notice

This is what all international students in Australia has been waiting for. To help Australia cope with workforce shortages, the Department of Home Affairs is suspending student visa conditions of working only 40 hours per fortnight. All international student visa holders will now be allowed to work more than their usual limit of 40 hours per fortnight. This is across ALL industries and all sectors, not just in the critical sectors.

Usually, if you are an international student, you first have to wait until your course starts before you can also start working. You must also wait until you are on your semester break before you can work full time.  Usually, your dependents are also restricted to only being able to work for 20 hours a week regardless.

This relaxation of work rights means that the Department of Home Affairs will not be monitoring how many hours you or your dependent works before or during the semester. All student visa holders and their dependents can now work unlimited hours. This means that if you hold an international student visa for Australia, you can work even before you start your course and throughout the semester for unlimited hours.

Note that this temporary suspension is due to be reviewed in April 2022.

Australia opens its borders to eligible visa holders

Migration Corporation of Australia migration agents can assist you with re-entering Australia with valid visas

The time has come and selected visa holders from the published list below will now be allowed entry into Australia from the 1 Dec 2021 with valid visas.

 

Are you an eligible visa holder? Is your visa still valid for travel into Australia at the time of your flight arrival? First of all, your visa must be listed in the published list below. Secondly, your visa must still be valid and not expired by the time you intend to travel to Australia.  You must also be fully vaccinated and have an International Vaccination Certificate. From the 1st December, you no longer need to apply for travel exemptions.

 

The eligible visas are as follows:

Subclass 200 – Refugee visa
Subclass 201 – In-country Special Humanitarian visa
Subclass 202 – Global Special Humanitarian visa
Subclass 203 – Emergency Rescue visa
Subclass 204 – Woman at Risk visa
Subclass 300 – Prospective Marriage visa
Subclass 400 – Temporary Work (Short Stay Specialist) visa
Subclass 403 – Temporary Work (International Relations) visa (other streams, including Australian Agriculture Visa stream)
Subclass 407 – Training visa
Subclass 408 – Temporary Activity visa
Subclass 417 – Working Holiday visa
Subclass 449 – Humanitarian Stay (Temporary) visa
Subclass 457 – Temporary Work (Skilled) visa
Subclass 461 – New Zealand Citizen Family Relationship visa
Subclass 462 – Work and Holiday visa

Note: If your visa is not listed above, note that additional visa subclasses may be added over time. 

 

Before you book your flight

It is recommended to make sure you are:

(a) aware of the quarantine arrangements for each state or territory to which you are travelling. If you are having to travel via another Australian city before you reach your final destination, you also need to check the domestic travel restrictions for each state and territory.

The quarantine arrangements are available for:

  • New South Wales
  • Victoria
  • Queensland
  • South Australia
  • Western Australia
  • Tasmania
  • Northern Territory
  • Australian Capital Territory

(b) have your International Vaccination Certificate or foreign vaccination certificate ready.

(c) Complete an Australian Travel Declaration form at least 72 hours prior to your departure from your country of origin;

(d) Produce a negative COVID-19 Polymerase Chain Reaction (PCR) test result taken within 3 days before your scheduled flight departure, unless you are exempt;

(e) at the airport, present items from (b), (c) and (d) to airline staff as well as your visa that is valid to enter Australia.

Visa previously refused and under an appeal? section 48 bar now expanded

Were you or someone you know, had a visa refusal? s48 barred? Are you on an appeal? As at the the 13 November 2021, Immigration will now expand onshore applications to include new visa streams.

Currently, if your last visa was refused onshore Australia, you can appeal against the decision. However, your options for applying for further visas whilst in Australia is limited. Your only option was to apply for permission to travel and lodge an application offshore. With the current COVID-19 pandemic, this is a bit tricky.  This is because there are only a limited number of people that can travel back to Australia. For those that do not fall in this category, you may be stuck overseas for an unpredictable amount of time.

As at the 13 Nov 2021, immigration will now allow visa applicants who were previously s48 barred, to now apply for subclass 491, 190 and 494 onshore. This means that if you had a visa refused before and still on a bridging visa in Australia, you can now apply for other visas without leaving Australia.  These visas include the state or territory sponsorship subclass 491, 190 or the employer-sponsored 494 visa. Note that sponsorship by the state/territory or an approved employer sponsor must be in place.

Australia welcomes parents as immediate family members for Australian PR and NZ citizens

Calling all parents of Australians and New Zealand citizens usually resident of Australia

It is what every Aussie or Kiwi citizen residing in Australia has been waiting for. If you are an Australian permanent resident/citizen or New Zealand citizen usually residing in Australia, you can now invite your parents to come over and visit. As at the 1st November 2021, Australia will also welcome parents and consider them as “immediate family members”.

Many families have struggled with their older parents unable to enter Australia during the pandemic. Their worries can now come to an end. If your parents already have a visa, they must apply for a travel exemption to enter Australia. You must provide evidence of:

  • your Australian citizenship or permanent residency grant
  • if you are a New Zealand citizen, your New Zealand citizenship grant
  • evidence of your relationship

You must submit your request for a travel exemption at least two weeks before you plan their travel into Australia. If they are not intending to travel for at least two months, do not apply yet.

Before they enter Australia, make sure they have a valid visa and their travel exemption.

Delays with initial entry into Australia permitted

Family or partner visa holders who continue to meet the criteria, have valid visas and have been granted their temporary or permanent residency may have reasons in delaying their initial entry into Australia.  The inevitable delays may mean that they cannot enter Australia by the “initial travel by” date specified on their visa grant letter.  There is now a streamlined way in being able to complete a form to facilitate your travel, once you have definite plans in entering Australia.

The travel facilitation letter will enable visa holders to depart their country and enter Australia, once their request (with the new proposed date) has been granted.  The request form is available on the Department’s website as per:

The visa holders must still continue to meet the criteria to hold the visa and have valid visas to qualify to apply.  Note that Prospective Marriage visa holders do not have to apply for a travel facilitation letter.  The Department should have contacted Prospective Marriage visa holders individually however according to the Department:

On 10 December 2020, Prospective Marriage visa holders or former visa holders who were outside Australia on that day, and who held a Prospective Marriage visa at any time between 6 October 2020 and 10 December 2020 had their visa validity period extended to 31 March 2022.

In all cases, as travel restrictions continuously change due to the COVID-19 pandemic, it is always best to check the Australian border’s travel-related news on the dedicated COVID-19 site.

International students working in hospitality and tourism can temporarily work full-time

Huge changes have been introduced recently for international students working in the hospitality and tourism sectors due to the recovery from the COVID-19 pandemic. International students can now temporarily work full-time and work conditions have been relaxed by the Minister of Immigration, Citizenship, Migrant Services and Cultural Affairs The Hon Alex Hawke MP, in a recent announcement.

Previously, international students working only in the agriculture and health certain sectors were allowed to work full time due to the pandemic recovery and the rest of the international student population were still required to maintain work conditions of only 40 hours per fortnight.  The recent change means that the department will take a flexible approach in monitoring work conditions for international students in the following specified sectors:

  • if international students are employed by an Aged Care approved provider or a commonwealth-funded aged care service provider with a RACS ID or a NAPS ID prior to the 08/09/2020; or
  • if international students are employed by a registered National Disability Insurance Scheme (NDIS) provider;
  • if international students are enrolled in a health-care related course and supporting the health effort against COVID-19 as directed by health officials;
  • if international students are employed in the agricultural sector;
  • if international students are employed in the tourism and hospitality sectors.

Further changes now also allow international students from the specified sectors cited above to be able to apply for the COVID-19 pandemic visa to allow a further 12-months stay with full-time work rights.  However, they are only allowed to apply for the COVID-19 visa not earlier than 90 days prior to their visas expiring.  This means that they cannot apply for the COVID-19 visa six months before their visa expires. They can only apply within the last three months or 90 days.
